GENERAL TERMS AND CONDITIONS FOR CONCLUDING A CONTRACT OF PURCHASE AND SALE THROUGH THE HOME SELECTION E-SHOP

These terms and conditions create rights and obligations for all persons who use and register on the website. https://homeselection.bg/.
These General Terms and Conditions govern the manner, terms and conditions for concluding a purchase contract through an e-shop. https://homeselection.bg/. The General Terms and Conditions are part of the Purchase and Sale Agreement between the merchant Home Selection Ltd (https://homeselection.bg/) and the User.
I. TERMS
In these Terms and Conditions, the terms are used in the following sense:

3. "E-shop" means an internet shop with an electronic address https://homeselection.bg/
4. "Goods" means each of the products offered in the e-shop, which is described by its main characteristics, is shown graphically and has a stated selling price.
5. "User" means any person who has visited, made a purchase order or purchased goods from the e-shop.
6. "CPA" is an abbreviation of the Consumer Protection Act.
7. "Credit institution" means any financial institution that provides earmarked credit for the purchase of goods.
II. GENERAL

2. The links to other websites provided on the Website are intended solely for the convenience of the User. 3. By accepting these Terms and Conditions, the User is deemed to be informed that he is in no way compelled or recommended to use other websites or information published on them. The use of other websites and any risks associated therewith are entirely at the User's expense and https://homeselection.bg/ shall not be liable in any way for any damage suffered by the User as a result thereof.
4. User agrees that https://homeselection.bg/ shall not be liable for any damages and/or lost profits and other losses of any kind or amount arising out of or resulting from the use of the website. In the event that the use of this website or any material on this website has caused damage requiring repair of equipment or recovery of information, the user assumes all costs and liabilities associated with remedying the damage.
5. By accepting these Terms and Conditions, the user is deemed to be informed that some of the goods advertised on the website may be advertised as available in the network of shops, but that they may not be available when the order is placed through the on-line purchasing system.
6. The website https://homeselection.bg/ provides the User with the opportunity to purchase the goods offered through the e-shop by placing an order and paying the quoted price, subject to these Terms and Conditions.
7. The contract of sale between https://homeselection.bg/ and the User shall be deemed concluded from the moment of confirmation by e-mail of the request /order / made by the User.
III. ORDER
1. Ordering through the website is voluntary and free of charge. The website can be browsed freely by any user without the need for registration and without any obligation to place an order.
2. In order to place an order it is necessary to fill in a registration form. The user submits an order by filling in the registration form published on the website https://homeselection.bg/ The request must include the delivery address, the user's email, a contact phone number, and the user's name.
3. Any request through the https://homeselection.bg/ website shall be submitted and executed in accordance with the Terms and Conditions. In the case of a dispute as to the person bound by the terms of these Terms and Conditions, the person who has paid the price of the goods requested for purchase shall be deemed to be a party to the contract.
4. The user agrees and undertakes that in using the website https://homeselection.bg/ to provide accurate, up-to-date and complete information when completing the registration form, hereafter referred to as Personal Data. If the User provides false, inaccurate, not current or incomplete information, the website https://homeselection.bg/ has the right to obscure or delete all information about it and to refuse later access to some or all of the services that the website provides, and shall not be liable in any way for any incorrect or inaccurately executed order related to the information received from the user.
5. Upon successful submission of the order, an employee of the website https://homeselection.bg/ will contact the User on the phone number provided by him to confirm that the goods can be delivered within the time specified in its description, and then send a confirmation email about the order. If it turns out that the goods cannot be delivered within the specified period, the employee will inform the User as to whether it can be delivered and within what period.
6. By placing an order through the online store https://homeselection.bg/ can only be purchased goods that the website allows to be added to the "shopping cart" of the User.
7. The information on the website about the goods offered through the online store, including but not limited to technical characteristics, method of use, warranty conditions, etc., is provided by the manufacturer or importer of the respective goods, as https://homeselection.bg/ shall not be liable in case of false, incorrect or inaccurate information, or information provided in a misleading manner, as well as in case of differences between the stated factual situation and the actual situation, in case of differences in color tones of the photos and the actual color of the goods, as well as in case of technical and typographical errors.
8. https://homeselection.bg/ has the right to freely, without notice and at any time make changes to the advertised goods, services, prices and other characteristics of the goods, and the User shall be deemed informed of the changes from the moment of their publication on the website. For some of the advertised goods and services, the information indicated may not be up to date, but in these cases the User will be expressly notified of this before delivery. It is possible that some of the information on the Website relates to goods that are no longer available or are not currently available, which will be expressly notified to the User when placing an order for such goods. In the cases referred to in this paragraph, the trader shall not be liable in any way to the User.
9. When submitting an order to the merchant, the User agrees to these Terms and Conditions by ticking the box "I agree to the Terms and Conditions" , which makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act and thus certifies that he is familiar with these Terms and Conditions, accepts them and undertakes to comply with them. This consent shall also be deemed to have been given by the User by performing the action of placing an order / purchase order / purchase order or by visiting the website only.
10. The user chooses the goods, services and quantity by placing an order.
11. The user is also obliged to choose the method of delivery (by courier or own transport). In case of delivery by courier, the exact delivery address shall be indicated.
12. Submission of the order ends with the User indicating the method of payment. The price can be paid in any of the following ways:

IV. PRICES
1. The prices quoted on the website are in Bulgarian leva and are valid only at the time of publication, as https://homeselection.bg/ may change them at any time without notice at its discretion and without being obliged to inform the User in advance.
2. The prices shown on the website are final and include all taxes and fees.
3. The cost of delivery is not included in the price.
4. The User is obliged to pay the price that was indicated on the Website at the time of placing the order, whether lower or higher than the new price.
5. In case of technical errors in the information provided on the Website, due to which the order cannot be fulfilled, https://homeselection.bg/ shall have the right to refuse to execute the order and shall not owe any compensation to the User, except for the refund of amounts already paid or deposited by the User under the submitted and cancelled order, if such amounts have been paid or deposited. Amounts shall be returned to the User by bank transfer to a bank account designated by the User.
V. WITHDRAWAL FROM A CONTRACT AND REFUND
1. On the basis of Art. 50 of the Consumer Protection Act, a consumer who is also a consumer within the meaning of the Consumer Protection Act within 14 /fourteen/ days of receipt of the goods has the right, without owing compensation or penalty to the trader and without giving reasons, to withdraw from the contract and return the goods received under the conditions set out below.
2. The user is obliged to inform in advance https://homeselection.bg/, to the following email address: info@homeselection.bg that, on the basis of Article 50 of the Consumer Protection Act, it withdraws from the contract, indicating a deadline for the return of the goods, which may not be later than 14 /fourteen/ days from its receipt.
3. The consumer must return the goods to one of the merchant's stores designated by the merchant.
4. The amount that the User has paid is returned to the bank account from which it was paid or in another convenient way for the User, after inspection of the goods and their acceptance by the trader.
5. Goods are accepted for return only if they have not been unpacked and their original packaging is retained.
6. The goods may be returned by the User in person or by his/her proxy, who must submit a written power of attorney.
7. All costs of returning the goods are borne by the User. Until the return of the goods by the consumer to the trader, the risk of accidental loss or damage shall be borne by the consumer.
8. If the User exercises his right under Art. 50 of the CPA, provided that he has fulfilled the above conditions, the trader is obliged to refund the price paid within 14 /fourteen/ days of notification of the withdrawal from the contract.
9. The right of withdrawal under Art. 50 of the CPA shall not apply in the hypotheses of Art. 57 of the CPA.
10. No refunds will be given for services already paid for and performed.
VI. DELIVERY
1. The delivery costs shall be borne by the Merchant.
2. When the ordered goods are available in stock, they shall be delivered to the address specified by the User within 3 working days. In case the goods are not available, the delivery period shall be the one indicated in the product description.
3. The time limit under the above clause shall commence when the goods are paid for.
4. The delivery shall be made by a subcontractor (courier, freight forwarder or transport company), as https://homeselection.bg/ reserves the right to change the subcontractor who performs the delivery, without being obliged to inform the User in advance, provided that this does not affect the manner, time and price of delivery.
5. Loading and unloading operations and the costs thereof upon delivery shall not be the responsibility or obligation of https://homeselection.bg/ /or to the courier/, but to the User of the goods.
6. The trader's obligation to deliver and hand over the goods shall be deemed to have been fulfilled by the delivery of the goods to the building in which the delivery address specified in the order is located or to the front door of the yard.
7. The trader is obliged to deliver the goods in appropriate packaging according to their type and the transport by which they are delivered.
8. If the delivery address is incomplete, incorrect or wrong address and/or telephone number when placing an order, the same shall be deemed invalid and no obligation for its performance shall arise for https://homeselection.bg/ and the contract shall be deemed cancelled.
9. If the User indicates as a method of payment - by bank transfer and does not make such payment within 3 days, then https://homeselection.bg/ may not confirm the delivery of the requested goods and accordingly the contract is deemed not to be concluded.
VII. DELIVERY OF THE GOODS
1. The goods shall be handed over to the User or to a third party who accepts and confirms receipt of the same on behalf of the User, and the documents accompanying the goods shall be signed upon delivery. The third party shall be deemed to be any person who has not made payment but agrees to accept the goods upon delivery to the delivery address specified by the User.
2. Upon receipt of the goods, the User is obliged to immediately inspect them and in the event that he finds obvious defects, the lack of any of the accompanying accessories and/or any of the documents required by Bulgarian law, he is obliged to immediately inform the person making the delivery and the trader. If he fails to do so, the goods shall be deemed to have been approved and the consumer shall lose the right to claim later that the goods were delivered to him with obvious defects, the absence of any of the accompanying accessories and/or of any of the documents required by Bulgarian law. Claims for goods purchased through the online store are made in accordance with the rules of the Consumer Protection Act and the terms and conditions of their commercial warranty.

4. If the User is not found within the delivery period at the address indicated by him or the User does not provide access and conditions for delivery of the goods within this period and this leads to the impossibility of delivery of the shipment not due to the fault of the trader, he is released from his obligation to deliver the ordered goods, and the User is obliged to receive it at the address indicated by the trader within 15 days of delivery. If the User does not receive the goods within this period, the contract shall be deemed cancelled and https://homeselection.bg/ shall be entitled to retain or receive 30% of the price of the goods as a penalty, and shall be obliged to return the remainder of the price already paid to the User within 14 days to a bank account specified by him.
VIII. REVIEW OF GOODS. ADVERTISING
1. Claims for goods purchased through the e-shop shall be made in accordance with the rules of the Consumer Protection Act in any of the outlets of https://homeselection.bg/, by e-mail info@homeselection.bg or Phone 087 989 9226.
2. The user is obliged to inspect the goods immediately upon receipt. If he/she finds any obvious defects, external visible damage to the integrity of the packaging found upon delivery, lack of any of the accompanying accessories, he/she shall immediately open the packaging and inspect the goods for possible defects. If any such defects are found, immediately inform the person making the delivery. In this case, a statement of delivery shall be drawn up in duplicate and signed by the recipient of the goods and the representative of the transport company. The report must describe the apparent defects.
3. Upon acceptance of the shipment by the User without remarks, any claims for external visible defects are unfounded and should not be satisfied. The User shall lose the right to claim for external visible defects in accordance with the purchase contract.
4. In the event that the goods subject to delivery do not comply with the requested The user has the right to request that the goods be brought into conformity with the contract by repairing or replacing the delivered goods with new, unless this is impossible or the chosen method is disproportionate compared to the other. The consumer has the right to exercise his rights within two years from the delivery of the goods.
5. Bringing the goods into conformity with the contract must be carried out within three months from the submission of the complaint by the User to the trader. After the expiry of the period, the Consumer has the right to terminate the contract and claim a refund or a price reduction.
6. The consumer shall not be entitled to claim cancellation of the contract and refund of the amount paid, nor reduction of the price of the goods when the trader agrees to replace the goods with new ones or to repair the goods within three months of the claim.
7. The trader is obliged to satisfy the Consumer's request for cancellation of the contract and to refund the amount paid by him when, after satisfying three claims of the consumer by repairing the same goods within the warranty period under Article 115 of the Consumer Protection Act, there is a subsequent occurrence of non-compliance of the goods with the contract of sale.
8. The consumer may not request cancellation of the contract if the non-conformity of the consumer goods with the contract is insignificant. In this case, he may only claim a price reduction.
9. The consumer does not owe any amounts to the trader for bringing the consumer goods into conformity with the contract. Nor shall he be liable for the cost of dispatching the goods or the cost of materials and labour for their repair.
10. If the User does not make a claim at the time of delivery of the goods or even if he makes such a claim, but does not sign a statement of conformity, he loses the right to later claim that the goods were delivered to him with obvious defects or defects, lack of any of the accompanying accessories and/or any of the documents required by Bulgarian law.
IX. FINAL CLAUSES

All technical data of the goods in the e-shop are external and include the outermost dimensions. There may be discrepancies in the colors of the photos and the actual shades of colors of the goods, for which the trader is not responsible and is not considered a discrepancy of the goods with the contract.
2. The decorative elements of the images with the goods are not included in the price quoted for the goods.
3. https://homeselection.bg/ does not guarantee permanent access to the e-shop. For technical reasons, access may be interrupted.
4. By accepting these terms and conditions, the user gives his/her unlimited and unconditional consent to the personal data provided by him/her to be collected, stored, processed and used by https://homeselection.bg/ and/or third parties authorised by the company, including but not limited to: courier companies, banks, etc., for the purposes of the performance of the distance selling contract and the delivery of ordered goods, and in the case of an online credit purchase: in connection with the credit application and the performance of the credit agreement, marketing and advertising purposes and analyses of the https://homeselection.bg/, participation in games, promotions and raffles organized by the company, as well as for any other purposes not prohibited by law. https://homeselection.bg/ guarantees the privacy of information containing personal data provided by the User. Disclosure is possible only in cases where the information is requested by state authorities or officials authorized by law to request and collect information containing personal data and in compliance with the statutory procedure.
